Stronger Voices for a Changing WorldACVO is mapping the Third Sector in Aberdeen because we want to develop THE THIRD SECTORVOICE in Aberdeen City. The National and Local Economic Climate is anticipating that the sector will respond to the growing needs that are emerging through the reduction in funding. The 'Volume and Value' of the Third Sector in Aberdeen is immense, however the questions that ACVO are always asked are…. Who are we ?? and What do we do ??We have a key role in helping the City and it's Citizens at this time. Phase 1 deadline was the 14th June, Phase 2 has begun! Draft Lead Funder Guidance for Review Deadline: Friday 17th September 2010)Third sector organisations frequently comment that their interactions with the public sector are complex and convoluted, and that they need to devote considerable energy simply to managing the reporting demands – energy which could be devoted to service delivery.This is particularly true when more than one funder is involved. Meanwhile, public sector bodies are keen to find ways to improve efficiency and to support cross-cutting outcomes, but are wary of 'letting go' and feel that their responsibilities demand close monitoring and control of any third sector activity which they are supporting.At the same time, public arms-length, private and third sector funding bodies use differing approaches and demand varying degrees of monitoring and influence. To help address these issues, the Third Sector Division (TSD) of the Scottish Government has drafted a guidance document (link below) with support from consultants and input from stakeholders. The TSD has already engaged with a variety of stakeholders in the production of the first draft and those organisations are being given the opportunity of commenting again on the resultant draft document. In addition, a number of other organisations have been included in the list for this second stage consultation. Consultees represent a broad range of stakeholders from the public and third sectors.A list of specific questions for consultees is attached as Appendix 3, but TSD would be delighted to have any general comments in addition to answers to these questions. Once all responses have been collated, a final version of the guidance will be made available on the Scottish Government website. The Equality Act 2010: Consultation on Secondary Legislation that will Enable Additional Support Needs Tribunals for Scotland (ASNTS) to Hear Disability Claims Cases in School Education (Deadline: 24th September 2010)This consultation seeks your views on secondary legislation that will enable the Additional Support Needs Tribunals for Scotland (ASNTS) to hear disability claims (harassment, victimisation and discrimination) cases in school education. The ASNTS was established in November 2005 by The Education (Additional Support for Learning) (Scotland) Act 2004 (as amended by the 2009 Act) to hear cases involving children and young people with additional support needs who have a dispute with their Education Authority, which could not be resolved by less formal means. The Equality Act 2010 will extend the Tribunal's jurisdiction to also hear disability claims cases in school education, and Scottish Ministers must write secondary legislation detailing new rules of practice and procedure to enable the Tribunal to hear these cases. The Equality Act 2010 will have a staggered commencement. |

The Tenancy Deposits Scheme (Scotland) Regulations 2010 (Deadline: 3rd October 2010)The Housing (Scotland) Act 2006 gives Scottish Ministers powers to bring forward regulations for the approval of schemes to safeguard tenancy deposits in Scotland. The Scottish Government has been working with key stakeholders to develop the draft regulations which will be offered for public consultation shortly. |
Blue Badge Reform (Deadline: 8th October 2010)A consultation on the Blue Badge Scheme to ensure that the Scheme, that has been running since 1971, stays fit for purpose in the 21st century. The consultatiion document sets out the Governments prpoosals to improve the Scheme over the next three years. It sets out proposals to make it easier to access and use by those who are eligible, easier to enforce in order to clamp down on those who flout the rules, to improve the administration of the Scheme and improve the assessment of eligibility criteria. |

Extension of Coverage of Freedom of Information (Scotland) Act 2002 (Deadline: 2nd November 2010)The consultation seeks views on whether FOI legislation should be extended to cover organisations such as contractors who build and/or maintain schools and hospitals; contractors who run privately managed prisons and provide prison escort services; contractors who build, manage and maintain trunk roads under private finance contracts; trusts created by local authorities for the provision of certain facilities such as for leisure and culture; Glasgow Housing Association and the Association of Chief Police Officers in Scotland. |
Public Services Reform (Scotland) Act 2010: Consultation on regulations relating to the establishment of SCSWIS and HIS. (Deadline: 5th November 2010)This consultation seeks your views on regulations drafted under the Public Services Reform (Scotland) Act 2010 relating to the establishment of Social Care and Social Work Scotland (SCSWIS) and Healthcare Improvement Scotland (HIS). These regulations will cover: registration; inspection; joint inspections; reporting; and fees. |

Public Bodies' Climate Change Duties: Putting It Into Practice (Deadline: Not Given)Part 4 of the Climate Change (Scotland) Act places duties on public bodies relating to climate change. The duties on the face of the Act (section 44) require that a public body must, in exercising its functions, act:
The duties come into force on the 1st January 2011 and apply to all 'public bodies', defined as a Scottish public authority within the meaning of section 3(1)(a) of the Freedom of Information (Scotland) Act 2002 (as amended). While compliance with the duty is a matter for the public bodies concerned, the Act requires that Scottish Ministers must give guidance to public bodies in relation to their climate change duties, and those bodies must have regard to such guidance. |
Land Use Strategy (Deadline: Not Given)Scotland's first Land Use Strategy provides the long term framework for sustainable land use. It sets out Minister's objectives for sustainable land use and the proposals and policies which contribute to meeting those objectives. The strategy must contribute to other obligations under the Climate Change (Scotland) Act 2009 on emissions reduction targets, climate change adaptation objectives as well as sustainable development. The Land Use Strategy will be laid by Scottish Ministers before the Scottish Parliament by 31 March 2011. |
